The short version of this story is that another open source project has forked from Oracle to achieve a level of freedom. In a recent vote the developers of Hudson polled 214 to 14 to rename the project and create a new fork called Jenkins. However, the real story is just a little below the surface and it involves trademarks and a cunning plan.

This article is good and mostly right except on one point: Oracle did not and does not own the Hudson trademark. They applied for the TM in Europe in October. The USA situation isn't clear. Sun did not own the Hudson TM.

Still, Oracle tried to bluff their way into grabbing control of the project. The community at large called their bluff. This frees up Kohsuke to continue his amazing work and the community to continue to build and extend Jenkins to suit their needs rather than Oracle's desire.

Oracle applied for the TM on Hudson on December 8th, 2010 (see http://tess2.uspto.gov/bin/showfield?f=doc&state=4006:27rb77.2.13 ). The mark has not yet been granted.

Perhaps you only have to claim to own the trademark!
Can anyone clarify the position as Oracle seem to be quite good and not being precise about the situation and I will see the news item is updated.
Does having a trademark "pending" carry any wieght?
